Yes, these pants do look like brand new. They look to be very high quality too. I measured the waist at 32” MAX and these pants are a bit higher waisted than jeans, so if you are near 32, it might not hurt putting a tape around yourself just below the navel. There are waist adjusters which will snug them down from their max size by an inch or two.

PS: These pants look a bit oddly shaped in the pictures, but they are quite normal. I think that look is because of the knee armor and the fact that they are just laying on the floor for the pics.
